1. Acceptance of Terms
Welcome to AIStarMap (hereinafter referred to as "the Platform"). Before using our services, please carefully read these Terms of Service (hereinafter referred to as "this Agreement"). By clicking accept, using the Platform, or creating an account, you agree to be bound by all terms of this Agreement. If you do not agree to any terms of this Agreement, please do not use the Platform.
The Platform reserves the right to modify this Agreement at any time. Modified terms will be published on the Platform and take effect upon publication. Continued use of the Platform constitutes acceptance of the modified Agreement.
2. User Accounts
2.1 Account Creation
Using the Platform requires creating a user account. You agree that all information provided (including but not limited to name, email, password, etc.) is true, accurate, valid, and does not contain any false or misleading information.
2.2 Account Responsibility
You are entirely responsible for the security of your account and password and should keep them properly. Any activity conducted through your account is deemed to be your own action. You should promptly notify us of any unauthorized use of your account.
2.3 Account Termination
The Platform reserves the right to terminate or suspend user accounts at any time for any reason (including but not limited to violations of this Agreement). After account termination, you remain responsible for all actions taken before termination.
3. User Conduct
You agree not to engage in the following activities when using the Platform:
- Uploading, posting, or transmitting any illegal, violent, harassing, defamatory, slanderous, abusive, obscene, or otherwise objectionable content
- Infringing on others' intellectual property rights, privacy rights, or other legitimate rights
- Sending spam, viruses, or any malicious code
- Attempting illegal access, damaging, or interfering with the Platform's system security
- Engaging in any form of fraud, deception, or misrepresentation
- Conducting any commercial activities, including but not limited to sales, advertising, or online marketing
- Impersonating others or falsely claiming relationships with others
- Posting or linking to any content that may cause system crashes, performance degradation, or poor user experience
4. Intellectual Property
4.1 Platform Content
All content on the Platform (including but not limited to text, images, code, design, AI tool descriptions, etc.) except user-generated content is the intellectual property of AIStarMap and its content providers. You are granted limited rights to use the content for personal, non-commercial browsing and use only.
4.2 User-Generated Content
You retain ownership of any content you upload or post to the Platform ("User Content"). However, by uploading or posting, you grant the Platform and its users a non-exclusive, free, perpetual right to use, copy, modify, publish, and distribute your User Content.
4.3 Prohibited Activities
Without explicit permission, you may not copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or use any part of the Platform in any form.
5. Disclaimer
5.1 Services Provided "As Is"
The Platform and all its content, features, and services are provided "as is" without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
5.2 Third-Party Tools and Links
AI tool descriptions, comparisons, and related links provided on the Platform are for reference only. The Platform makes no warranties regarding the accuracy, reliability, legality, or operational status of these third-party tools. Any consequences from using third-party tools are solely at the user's own risk.
5.3 Data Accuracy
While we strive to ensure the accuracy of platform information, the Platform does not guarantee that all information is completely accurate, current, or error-free. Information such as AI tool features, prices, and availability may change at any time, and the Platform does not commit to real-time synchronization.
5.4 Service Availability
The Platform does not guarantee uninterrupted, timely, secure, or error-free service. The Platform is not responsible for any interruptions, delays, transmission errors, or service disruptions caused by uncontrollable factors.
6. Limitation of Liability
In no event shall AIStarMap, its directors, employees, or agents be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use the Platform or related services, even if we have been advised of the possibility of such damages.
You are solely responsible for your decisions regarding the use of the Platform and any information, advice, or other content provided.
7. Privacy and Data Protection
Your personal information will be processed in accordance with our Privacy Policy. By using the Platform, you agree to the collection, use, and disclosure of your personal information as outlined in the Privacy Policy. We strictly comply with international data protection regulations, including the European General Data Protection Regulation (GDPR) and other applicable data protection laws. If you are a resident of the European Union (EU) or European Economic Area (EEA), you have rights under GDPR, including but not limited to access, rectification, erasure, and data portability.
8. Third-Party Links and Content
The Platform may contain links to third-party websites. The Platform is not responsible for the content, accuracy, legality, or security of third-party websites. Accessing third-party websites is entirely at your own risk.
9. Prohibited Conduct and Enforcement
The Platform reserves the right to warn, restrict, suspend, or permanently terminate accounts of users who violate this Agreement or harm the Platform or other users' rights. The Platform may also report illegal activities to relevant law enforcement authorities.
10. Severability
If any term of this Agreement is deemed illegal or unenforceable, that term shall be modified or deleted without affecting the validity of the remaining terms.
11. Entire Agreement
This Agreement, together with the Privacy Policy and any other policies or rules we publish, constitutes the complete agreement between you and the Platform regarding our services and supersedes any previous agreements and understandings. In case of conflict between this Agreement and any other written agreement, the latest published version shall prevail.
12. Jurisdiction, Arbitration, and Dispute Resolution
12.1 Applicable Law
This Agreement shall be interpreted in accordance with the laws of the People's Republic of China, without regard to conflict of law principles. For users in the EU and other regions, applicable local laws may also apply.
12.2 Dispute Resolution
Please first try to resolve any disputes through friendly negotiation. If negotiation fails, you and the Platform agree to resolve disputes through litigation or arbitration in courts of China or relevant jurisdictions, unless applicable laws require other procedures.
13. Severability
If any term of this Agreement is deemed illegal, invalid, or unenforceable, that term shall be modified to the maximum extent possible to make it effective, or deleted, without affecting the validity of the remaining terms.
14. Force Majeure
We are not responsible for service interruptions caused by unforeseeable, uncontrollable events (including but not limited to natural disasters, war, terrorist activities, government actions, internet outages, etc.). In such cases, we will endeavor to restore services but cannot guarantee a specific recovery timeline.
15. Third-Party Rights
Nothing in this Agreement creates, or is intended to create, any agency, partnership, or joint venture relationship between any party and third parties. You may not represent or make commitments to third parties on behalf of the Platform.
16. Amendments and Effectiveness
Amendments to these terms take effect upon publication. We will notify users via email or platform notifications before amendments. If you are dissatisfied with the amendments, you should stop using the Platform. Continued use constitutes acceptance of the amended terms.
17. Notices
Any notice we send you may be delivered via email, platform messaging, or posting on the Platform. A notice is deemed delivered 24 hours after electronic delivery.
18. International Use
The Platform is maintained and operated by the AIStarMap Development Team in China. If you use the Platform from other countries or regions, you are responsible for ensuring your use complies with local laws. Certain content or features may be restricted or unavailable in your jurisdiction.
